Welcome to the Baja Mining Corp. Class Action website

A class action was commenced on behalf of all persons and entities, wherever they may reside or be domiciled, who acquired Baja Mining Corp. securities between November 1, 2010 and April 23, 2012 (the “Class Period”) and who held some or all of those securities as of April 23, 2012.

A settlement was reached with the defendants in which $11,000,000 was paid for the benefit of Class Members (the “Settlement”). In exchange, the defendants were provided with a full and final release of claims made against them in relation to the facts and issues alleged or which could have been alleged in the Baja Mining Class Action Lawsuit. The defendants do not admit any wrongdoing or liability in relation to the Baja Mining Class Action Lawsuit. The Settlement represents a final resolution of all issues contained in the Baja Mining Class Action Lawsuit.


The period during which Class Members could make claims for compensation out of the Settlement was open from April 6 - August 4, 2016. The claims period is now closed. If you did not make a claim on or before August 4, 2016 and did not previously validly opt out, there is no further recourse against Baja Mining Corp.

If you made a valid claim on or before August 4, 2016, you will receive confirmation within 60 days of submitting your claim. If your claim contained a technical deficiency, you will be notified and will have 30 days to correct the error. Once all claims and deficiency responses are processed, decision letters regarding each claim will be sent. A claim may be fully accepted, partially accepted, or denied. Final compensation will be calculated and sent in accordance with the Plan of Distribution. Accurate claims processing takes time and the date for payment depends on several factors. The specific date for payment is unknown at this time.
